Benjamin David Lundquist to be sentenced

Benjamin David Lundquist to be sentenced

In a court order issued by Sixth Judicial District Court Judge Mark Starr, Judge Starr held that Benjamin David Lundquist did not have a mental illness or cognitive impairment as to afford him the mental illness defense. Judge Starr also found that the defense did not prove by a preponderance of the evidence that Lundquist did not know the nature of his act or that killing Mr. Gangness was morally wrong. Judge Starr previously convicted Lundquist of Murder in the Second Degree in the death of Mr. Gangness. The case was prosecuted by Assistant St. Louis County Attorney Jeff Vlatkovich. Sentencing is set for June 13.
