4CIVILDIVISIONKimMakiaseasonedprofessionalwithmorethan10yearsofexperiencetwoofwhichhavebeenintheCivilDivisionisnowthatDivisionsHead.St.LouisCountygovernmentreliesheavilyontheCivilDivisionanditstimelylegalcounselfordailyoperationalinteractions.ItssupportandadviceisfoundationaltodecisionsmadebytheCountyCommissionerstheCountyAdministratorcountydepartmentheadsandtheiremployees.ArrowheadRegionalCorrectionsalsoreliesontheCivilDivisionslegaladvice.OtherareasofservicebytheDivisionin2012includedDevelopmentofknowledgeintheproposedexpansionoftheminingindustryenablingthecountytobeneciallypositionitselfforyearstocome.UnanticipatedworkloadfollowingtheJuneoodinvolving125differentprojectscontractsandgrantagreementscoveringmillionsofdollarsofroadreconstructionincludingJeanDuluthandHainesRoads.AtthesametimeattorneysworkeddozensofhoursonthelegalitiesofbringingtogethertheDuluthCityAssessorsOfcewiththeCountyAssessorsOfce.Combiningthetwoofceseliminatesduplicationofservicescreatesworkprocessefcienciesandensuresauniformsetofstandardsandexpectationsaspropertyassessmentsareconducted.Thismeanscountytaxpayerswillreceiveimprovedservicethroughuniformpropertytaxevaluationsforallcitizensthroughoutthecounty.WithcustomerserviceasitsprimaryfocustheCivilDivisionensurestimelywell-reasonedandreliableadvicetoAdministrationandvariousdepartmentsaswell.CivilDivisionKimMakiCivilDivisionHeadDuluthOfceLeslieBeiersNickCampanarioJimNephewThomasStanleyTimothyTysdal2012STLOUISCOUNTYATTORNEYSANNUALREPORTCivilDivisionprovidedlegalcounselformultiplereconstructionprojectssuchasJeanDuluthRoadshownabove. CRIMINALDIVISIONGaryBjorklundleadsthe13criminalprosecutorswhoworkinDuluthVirginiaandHibbing.ThishighlyeffectiveteamisresponsibleforchargingandprosecutingalllevelsofadultcriminaloffenseswithinSt.LouisCountyincludingfeloniesgrossmisdemeanorsmisdemeanorsandcountyordinanceviolations.AdditionallytheprosecutorsareinvolvedinproblemsolvinginthespecialtycourtsincludingDWIandDrugCourtandMentalHealthCourt.CriminalDivisionattorneysareresponsibleforsettingupandconductinglawenforcementtrainingtosupportpoliceinthelatestchangesinlawsandregulations.Thesetrainingsessionsaredesignedtoimproveinvestigationproceduressearchandseizuremethodsandotheraspectsofcriminalinvestigation.ParticularlyhighproleanddifcultcasesthattheDivisionwasinvolvedinthispastyearincludedBrianBridgeswasconvictedoftwocountsofFirstDegreeCriminalSexualConductFirstDegreeBurglaryandAssaultintheThirdDegree.Hewassentencedto26yearsinprison.ThecaseinvolvedahomeinvasionandthebrutalbeatingandrapeofaHibbingwoman.RandyBoettcherwasfoundguiltyof11countsofCriminalSexualConductandPossessingChildPornography.TheCourtsentencedBoettchertoatotalof252monthsinprison.AndrewClarkewasconvictedoffourcountsofPossessingandSellingDrugs.ThejuryalsofoundClarketobeacareeroffender.Hereceiveda258monthprisonsentencewhichwasdoubletheamountundertheMinnesotaSentencingGuidelines.DalePorterwasfoundguiltyofAssaultintheSecondDegreeTerroristicThreatsandIllegalPossessionofaPistol.TheconvictionsweresecuredeventhoughthevictimrefusedtocooperatewiththeprosecutionandultimatelytestiedonbehalfofPorterattrial.Theextensiveinvestigationbylawenforcementandthecompilingofadditionalevidencemadethisatextbookcaseofevidence-basedprosecution.PaulWellewasconvictedofMurderintheSecondDegreeandwassentencedto216monthsinprison.WellewasconvictedofkillingPaulAndersonoutsideabarinProctor.CriminalDivision5GaryBjorklundCriminalDivisionHeadDuluthOfceJonHoletsChristopherPinkertJessicaSmithNateStummeRebekkaStummeKristenSwansonVickyWantaVirginaOfceMichelleAndersonGordonColdagelliLeahStauberHibbingOfceBrianSimonsonKarlSundquistJeffVlatkovichWWW.STLOUISCOUNTYMN.GOVCOUNTYATTORNEY InnovationPartnershipLeadershipInnovationPartnershipLeadership11WWW.STLOUISCOUNTYMN.GOVCOUNTYATTORNEYPHHSDivisionAttorneyshaveregularlyappearedinMinnesotaAppellatecourts.TheMinnesotaCourtofAppealsledfouropinionsin2012oncaseshandledbytheDivisionAttorneys.TheysuccessfullydefendedtheDistrictCourtdecisionineachofthesecases.AlsothroughtheDivisionsworkSt.LouisCountyagainexceededthefederalbenchmarkforpaternityestablishmentcases.U.S.AttorneyandSt.LouisCountySt.LouisCountycitizenscontinuetobenetfromthestrongrelationshipbetweenourofceandtheofceofB.ToddJonestheMinnesotaU.S.Attorney.Thishasbeenespeciallysignicantwiththepublicsafetyandhealthissuesinvolvedinthesaleanduseofsyntheticsubstancesrearmviolenceandnarcoticstrafcking.RacialJusticeImprovementProjectRJIPTaskforceLeadershipcontinuesbetweenourofcetheDistrictCourtjudgesthePublicDefendersofceArrowheadRegionalCorrectionscommunityrepresentativesandlawenforcement.TheTaskforceisaspeciallyfundedgrantprojectoftheAmericanBarAssociationABAchargedwithaddressingracialdisparitiesinpretrialreleaseandbaildecisions.Followingayearandahalfofplanningandanalysisthetaskforceconductedtraininglastsummerforallofthejudgesinthedistrictaswellasallprobationofcersinvolvedinthepretrialreleasestage.During2013auniformchecklistandevaluationtoolwillbeimplementedandusedbyalljudges.ThispretrialprocessisexpectedtobeamodelfortheABA.MediaandtheCourts101Fiverstevertrainingeventsforareamediaoutletswereheldlastyearfocusingonthebasicsofcriminalprocedurefromarresttosentencing.Morethan40journalistsfromthreelocaltelevisionstationsandtworegionaldailynewspaperslearnedabouttheinnerworkingsofthecriminaljusticesystem.Theyalsoreceivedreinforcementfortheirroleinthecollaborativerelationshipneededbetweenthefourthestateandthecriminaljusticesysteminademocraticsociety.TrafckingAwarenessandPreventionInconjunctionwithPAVSAProgramforAidtoVictimsofSexualAssaultAICHOAmericanIndianCommunityHousingOrganizationtheCityofDuluthandtheMinnesotaWomensFoundationtheCountyAttorneysOfcecontinuestoparticipateineffortstoprotectthesafetyofyounggirlsandwomenbyincreasedpublicawarenessandsupportfortheregionalandstatewideanti-sextrafckingefforts.WorkingincollaborationwiththeCityofDuluththeSt.LouisCountyAttorneysOfceisveryproudtocontinuetobeapartnerinthisefforttoprotectchildrenandenhancethecommunitysresponse.In2012opportunitiestoeducatethepublicoccurredthroughpressconferencescommunityforumsandoutreachefforts.ADrummingCirclewasheldfollowingtheTrafckingAwarenessPressConference.ItwasledbyNativewomenandmenandhonoredthesurvivorsofsextrafcking.
