Septic System Program Requirements When Buying or Selling Property
St. Louis County Individual Sewage Treatment Ordinance 61 requires that property ownership cannot be transferred unless one of the following conditions exist:
- The seller discloses to the buyer in a sworn affidavit that there is not an individual sewage treatment system on the property, or
- The property has a valild Certificate of Compliance or Notice of Non-Conforming, or
- A Notice of Non-Compliance has been issued for the property (a Transfer Agreement specifying replacement must be included in this case)
- When a Notice of Non-Compliance has been issued, an SSTS permit application, design, and fee must be submitted within 60 days of the Notice. The system must be replaced within 24 months for non-shoreland property, and within 12 months for shoreland property.
- In the case of a winter sale, the seller and the buyer file a Transfer Agreement with St. Louis County Environmental Services Department. This will allow a delay in the inspection, however one will still be required when conditions allow (before June 1). As of June 30, 2014 an escrow of 100% of the estimated repair/replacement cost is required.
